Protection of an international brand and transfer of a domain name
Court protection of the rights of an international home appliance manufacturer in a dispute over the unlawful use of its trademark.
DEGA Partners represented an international company in a dispute over the use of its trademark in a domain name and on a website that presented itself as the brand's official resource. The legal position covered proving the infringement of the trademark rights, the risk of misleading consumers about the seller's official status and the negative consequences for the right holder's business reputation.
The court prohibited the unlawful use of the trademark, ordered the domain name to be transferred to the right holder and granted the claim for compensation of non-pecuniary damage to business reputation. The decision has entered into force and has been enforced.
Recovery of an overpayment for natural gas
Successful recovery of overpaid funds for an international industrial company.
DEGA Partners represented an international industrial company in a court dispute with a natural gas supplier over the return of overpaid funds.
The legal support included analysing the contract terms, the actual volumes consumed and the financial settlements between the parties, and building the evidence base.
As a result of the court proceedings, the overpaid amount was recovered for the client.
Challenging the blocking of tax invoices
Court protection of a business in a dispute over the refusal to register tax invoices. DEGA Partners represented a company in a tax dispute concerning the suspension of the registration of tax invoices.
The team built an evidence base confirming that the business transactions were genuine, that the primary documents were proper and that there were no legal grounds for refusing registration, and successfully challenged the decisions of the tax authority in court.
Protection of the corporate rights of a company participant
Representation in a corporate dispute over the lawfulness of decisions of the general meeting of participants of an LLC. DEGA Partners attorneys represented a participant of a limited liability company in a dispute over the invalidation of decisions of the general meeting.
The legal support was aimed at protecting the client's corporate rights, verifying the lawfulness of the decisions taken and using court mechanisms to protect the participant's right to take part in the management of the company.
